1. Agreement

By subscribing to and using Cost Impact Monitor, you agree to these Terms of Service in full. These terms constitute a binding agreement between you and Daniel Diosi & Partners, the operator of Cost Impact Monitor.

2. The Service

Cost Impact Monitor is a software platform that enables organisations to track costs and KPIs by department and measure the statistical relationship between the two. Access is provided on an annual subscription basis. The platform is hosted on EU-based infrastructure and is accessible via web browser.

3. Subscription and Billing

Subscriptions are billed annually. Your subscription begins on the date of activation and renews automatically unless cancelled. Pricing is as published on costimpactmonitor.com at the time of purchase.

4. What Is Included

Your annual subscription includes access to the Cost Impact Monitor platform and all its analytical features, initial onboarding and configuration support, training materials, and the AI Analysis module at no additional cost.

5. What Is Not Included

The annual software licence does not include ongoing consultation, data interpretation support, strategic advice, or any form of extended assistance beyond the initial onboarding. Requests for ongoing analytical support, configuration changes after onboarding, or discussion of results and their business implications fall outside the scope of the software licence and are available separately under a managed service engagement. Daniel Diosi & Partners is under no obligation to provide such services as part of a standard subscription.

6. Client Responsibilities

You are responsible for the accuracy of data entered into the platform by your team. The quality of analysis produced by Cost Impact Monitor depends directly on the accuracy and consistency of the data submitted. Daniel Diosi & Partners accepts no liability for analytical outputs derived from inaccurate, incomplete, or inconsistently entered data.

You are also responsible for managing your user hierarchy, ensuring appropriate access controls are in place within your organisation, and maintaining the confidentiality of account credentials.

7. Cancellation

You may cancel your subscription at any time by contacting us at hello@costimpactmonitor.com. Upon cancellation, your billing will not renew at the end of the current cycle. You retain full access to the platform until your current licence period expires. No partial refunds are issued for unused time within an active billing period.

8. Refunds

Refunds are not available on the basis of non-use, change of business circumstance, or a determination by the subscriber that the platform does not meet their expectations after purchase.

A refund may be considered if Cost Impact Monitor experiences a prolonged period of downtime or critical functional failure caused by issues on our end, to the extent that normal use of the platform becomes impossible. Any refund request on this basis must be submitted in writing to hello@costimpactmonitor.com with supporting documentation. Daniel Diosi & Partners will assess each case individually and at its sole discretion.

9. Intellectual Property

All software, methodology, content, and materials associated with Cost Impact Monitor remain the intellectual property of Daniel Diosi & Partners. Subscribers are granted a non-exclusive, non-transferable licence to use the platform for their own internal business purposes during the subscription period. No part of the platform may be reproduced, resold, or redistributed without prior written consent.

10. Limitation of Liability

Cost Impact Monitor is an analytical tool. Decisions made on the basis of its outputs are the sole responsibility of the subscriber. Daniel Diosi & Partners accepts no liability for business decisions, financial outcomes, or losses arising from the use or interpretation of platform results.

To the maximum extent permitted by applicable law, our total liability to any subscriber shall not exceed the amount paid by that subscriber in the twelve months preceding the claim.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of Georgia. Any disputes arising under these terms shall be subject to the jurisdiction of the competent courts accordingly.

12. Changes to These Terms

We reserve the right to update these terms at any time. Material changes will be communicated to active subscribers by email with reasonable notice. Continued use of the platform following notification constitutes acceptance of the updated terms.
